The City of Weyburn Zoning Bylaw permits owners of dwellings to conduct certain business from their homes. These permitted home-based businesses must comply with a list of regulation, the intent of which is to maintain a safe, quiet, clean and aesthetically pleasant living environment for neighbourhood residents. Business activities which pose a threat to the maintenance of a peaceful neighbourhood are not permitted, and therefore, must locate in commercial or industrial areas which are provided throughout the City for this purpose.
A home-based business means a use conducted entirely within a dwelling by the inhabitants, and which use is clearly secondary to the use of the dwelling (not more than 25% of the floor area may be provided to the business). Home-based businesses are intended to foster economic growth in the City of Weyburn by accompanying small family business enterprises.
General Regulations
- Only residents of the dwelling may be employed with the dwelling
- Occupations shall not take up more than 25% of the floor area
- Exterior storage or indication of home-based business, or variation from the normal residential character is prohibited
- Articles offered for sale shall be limited to those produced by the home occupation
- No advertising the location of a home-based business through any media is permitted
Prior to applying, you should discuss the outlines of your venture with Planning Department at City Hall. They will determine if your proposal is acceptable in regard to location and land use purposes. There are some home occupations that are considered non-controversial and can be approved by the Development Officer without public notice. Should public notice be necessary, a notice is then circulated to all neighbours within 50m of the proposed home occupation to allow for comments or concerns. The application will then go before Council for their final approval. The process generally will take between 3-4 weeks.
There is a one-time application fee of $250.00 (non-transferable to an alternate address, or an alternate resident).
Following the Decision
If the home-based business is approved; the applicant will receive a letter of approval and permit with, or without, conditions. The applicant will also then need to obtain a City of Weyburn annual business license through the City Clerk.
Home-based businesses are subject to inspection by the Development Officer during regular business hours to ensure compliance with these regulations or any conditions included in any approval.
Home-based business permits are subject to the condition that the permit may be revoked at any time, if in the opinion of City Council, or the Development Officer, the use is, or has become, detrimental to the amenities of the neighbourhood.
